Effective January 1, 2018 (ג€Program Dateג€), these Terms and Conditions (ג€Termsג€) will govern the 4Fuel LLC Rewardsֲ® Program (ג€Programג€) and hereby supersede and replace all previous terms and conditions that were effective prior to the Program Date.
These Terms apply to all Members of the Program regardless of country of residence.
The terms ג€youג€ and yourג€ are used in these Terms to refer to individual Members who are enrolled in the Program and have created a Member Account (ג€Accountג€).
ABOUT THE PROGRAM
The Program is administered by 4Fuel LLC (ג€FUELג€), which is the party with whom you are entering into a contract by agreeing to these Terms, and it is located in the United States at 2004 Grant St, Hollywood, FL 33020.
The Program gives Members the opportunity to earn Fuel Poke Rewardsֲ® Points (ג€Pointsג€) that can be redeemed for free benefits. Further details on redemption options are described below and available on Fuel-Miami.com.
BECOMING A MEMBER OF THE PROGRAM AND CREATING AN ACCOUNT
For individuals who are not yet Members, you may enroll in the Program as a new Member online at www.fuel-miami.com.
You must be the age of majority to be a Member of the Program.
To create a Member Account, which tracks your Points and account activity, you must provide accurate and complete information, including a current, valid e-mail address, phone number, and mailing address (ג€Account Informationג€). You may never use another personג€™s Account without permission.
CONSENT TO THESE TERMS AND BWIג€™S PRIVACY POLICY
By becoming a Member or staying in the program, you are providing your Personal information to FUEL.
Your Membership in the Program constitutes your consent and acceptance of these Terms.
USE OF YOUR ACCOUNT INFORMATION
In addition to any rights granted to FUEL with respect to your Account Information in the FUEL Privacy Policy, we use your Account Information to manage and administer your participation in the Program and, to the extent permitted by applicable law, to improve the Program.
You may edit your Account Information at any time by logging into your Account and updating your profile. You are responsible for keeping your Account Information current and accurate. FUEL provides all statements, communications, and updates about the Program and your Account via email to the address in your Account. Communication is critical to the administration of the Program. If you fail to maintain up-to-date Account Information, including a valid, subscribed e-mail address, you may not receive statements or other important communications. In addition, without a valid e-mail address on file you may not be able to receive certain types of awards and gift cards. If you do not maintain accurate and current Account Information, FUEL reserves the right to take any action that it deems necessary to protect your Account against unauthorized access or fraud, including suspending or restricting your account until your Account Information can be confirmed.
Also, if you do not opt-in to receive communications from FUEL you will not be able to fully participate in the Program, or experience the full range of benefits available to you as a Member of the Program. To unsubscribe from an email or other messaging, please follow the instructions in any email or messages you receive.
You can view your Account Information at any time by logging into your Account at www.fuel-miami.com.
To the extent permitted by applicable law, it is your responsibility to monitor Account activity and report suspicious activity to FUEL.
EARNING POINTS
All purchases at FUEL are eligible to earn points.
You earn two (2) Points for each $1.00 U.S. Dollar (or fraction of a U.S. Dollar) paid.
Points are added to your Account as soon as Reward card is swiped before/after payment of purchase.
REDEEMING POINTS
For every 150 points earned, you will be eligible for a $10 FUEL gift card which can be used for purchases at a FUEL location.
POINT EXPIRATION and Membership Cancellation
Points earned under the Program do not expire.
Fuel reserves the right to cancel any Member Account and revoke any and all unredeemed Points in the event of any of the following circumstances:
APPLICABLE LAW; ARBITRATION

Unless prohibited by the laws of your jurisdiction, any and all disputes between you and FUEL arising under or related in any way to these Terms or your participation in the Program (defined below as Claims) shall be resolved by applying the laws of Florida or the federal laws of the United States, as applicable, without regard to conflict of laws principles.
Further, any and all disputes between you and FUEL arising under or related in any way to these Terms or your participation in the Program must be resolved through binding arbitration as described in this section. This agreement to arbitrate is intended to be interpreted broadly. It includes, but is not limited to, all claims and disputes, including class action claims, relating to and arising from your participation in the Program, including but not limited to any claims related to or arising out of unauthorized disclosure of or access to any Account Information (ג€Security Breachג€), advertising or marketing claims, product liability, or consumer claims (ג€Claimsג€).
YOU AGREE THAT BY ENTERING INTO THIS AGREEMENT, YOU AND FUEL ARE EACH WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. YOU AND FUEL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. ANY ARBITRATION WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED.
OTHER TERMS AND CONDITIONS
Unless prohibited by the laws of your jurisdiction, all Terms, including all Point earning and redemption requirements are subject to revision without notice by FUEL, in its sole and absolute discretion.
Determination and payment of tax liability is your sole responsibility as a Member.
Neither FUEL, its, employees, agents, nor partners, shall be responsible for lost or stolen awards.
Points are not transferable nor redeemable for cash or any other form of credit unless specifically required by applicable law. Point value is set by FUEL in its sole discretion and may be updated from time to time, as permitted by applicable law.
FUEL may terminate the Program at any time without prior notice.
FUEL assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, or technical error.
We may revise these Terms from time to time by posting an updated version on this page. If you are a Member and a revision meaningfully reduces your rights, we will notify you by sending a message to the email address associated with your Account and you agree that the revised Terms will be effective ninety (90) days after the message is sent to you. Your continued participation in the Program is subject to the most current, effective version of these Terms.
These Terms only apply to the extent permitted by the laws of the country, state, or province of the applicable Member. To the extent any of the foregoing limitations are not permitted under the laws of your country, state, or province, you agree that the remaining portions of these Terms that are permissible shall apply to the maximum extent permitted by law.
